1 Acceptance of Terms

By accessing or using the Hire Car PNG platform, you agree to be bound by these Terms and Conditions. If you do not agree to all terms, please do not use our services.

Important: These terms constitute a legally binding agreement between you and Hire Car PNG. Your use of the platform indicates your acceptance of these terms.

2 Definitions
"Platform"
The Hire Car PNG website and all related services, features, and content.
"User"
Any person or entity accessing or using the Platform, including Customers and Businesses.
"Customer"
A User seeking to hire vehicles through the Platform.
"Business"
A User listing vehicles for hire through the Platform (car rental companies, individual owners).
"Vehicle Listing"
A vehicle offered for hire by a Business on the Platform.
"Booking"
A confirmed agreement between a Customer and Business for vehicle hire.
3 User Accounts
3.1 Account Registration

To use certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information and to update it as necessary.

3.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of unauthorized use.

3.3 Eligibility
  • You must be at least 18 years old to use the Platform
  • Businesses must provide valid registration documents
  • Customers must have a valid driver's license
  • You must have the legal capacity to enter binding contracts

Warning: Providing false information may result in immediate account termination and legal action.

4 Terms for Customers
4.1 Hiring Process
  1. Browse available vehicles and select your desired vehicle
  2. Submit a hire request with your details and required dates
  3. Wait for Business approval (typically within 24 hours)
  4. Upon approval, arrange pickup with the Business
  5. Inspect vehicle and complete necessary documentation
4.2 Customer Obligations
  • Provide accurate personal and contact information
  • Present valid driver's license at pickup
  • Return vehicle on time and in same condition
  • Pay all applicable fees and security deposits
  • Use vehicle in accordance with PNG traffic laws
4.3 Prohibited Uses
  • No subletting or re-renting the vehicle
  • No use for illegal activities
  • No exceeding agreed mileage limits
  • No off-road driving unless specifically permitted
  • No smoking in vehicles (unless permitted)

Security Deposit K200 - K2000 (varies by vehicle)
Booking Confirmation Within 24 hours of request
5 Terms for Businesses
5.1 Business Registration
  • Businesses must provide valid registration documents
  • Tax Identification Number (TIN) required
  • Business address and contact information must be verified
  • Insurance documentation must be current
5.2 Vehicle Listings
  • All vehicle information must be accurate and current
  • Photos must represent actual vehicles
  • Pricing must include all applicable fees
  • Availability calendar must be kept up to date
  • Terms and conditions must be clearly stated
5.3 Business Obligations
  • Respond to hire requests within 24 hours
  • Maintain vehicles in safe, roadworthy condition
  • Honor confirmed bookings
  • Provide accurate vehicle at agreed time
  • Handle customer disputes professionally

Subscription Benefit: Active subscribers receive priority placement in search results and access to business analytics.

6 Payments & Fees
6.1 Customer Payments
  • Payment methods: Bank transfer, mobile money, cash (at provider discretion)
  • Full payment required before vehicle pickup
  • Security deposit collected at pickup, refunded within 3-5 days after return
  • Late return fees apply (typically equal to daily rate)
6.2 Business Fees
  • Subscription fees are charged monthly or annually
  • No commission on bookings
  • Payment processing fees may apply
  • Late payment penalties apply after 7 days

7 Cancellation Policy
7.1 Customer Cancellations
  • 48+ hours before pickup: Full refund
  • 24-48 hours before pickup: 50% refund
  • Less than 24 hours: No refund
  • No-show: No refund
7.2 Business Cancellations
  • Businesses may cancel only in exceptional circumstances
  • Must notify customer immediately
  • Must assist in finding alternative vehicle
  • Penalties apply for frequent cancellations
7.3 Platform Cancellations
  • We reserve the right to cancel bookings that violate these terms
  • Full refunds issued for platform-initiated cancellations
  • Suspicious activity may result in booking cancellation
8 Privacy & Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy.

  • We collect necessary information to provide services
  • Data is stored securely with industry-standard encryption
  • We never sell your personal information
  • You may request data deletion (subject to legal requirements)
  • Cookies are used to improve user experience

9 Limitation of Liability

Hire Car PNG acts as an intermediary platform connecting Customers and Businesses. We are not a party to rental agreements between users.

  • We are not liable for disputes between Customers and Businesses
  • We do not guarantee vehicle availability or condition
  • Maximum liability is limited to fees paid in last 12 months
  • We are not liable for indirect or consequential damages
  • We do not guarantee uninterrupted or error-free service
10 Termination
10.1 By User
  • Customers may delete accounts at any time
  • Businesses must settle outstanding fees before termination
  • Subscription fees are non-refundable upon termination
10.2 By Platform
  • We may suspend or terminate accounts for violations
  • Fraudulent activity results in immediate termination
  • Repeated cancellations may lead to account suspension
  • Non-payment results in service suspension
11 Dispute Resolution
  1. Direct Resolution: First, attempt to resolve with the other party
  2. Platform Mediation: Contact support@hirecarpng.com for assistance
  3. Arbitration: If unresolved, disputes go to arbitration in Port Moresby
  4. Governing Law: These terms are governed by PNG law
